Filing a criminal complaint on suspicion of violation of official secrets

The state capital of Wiesbaden has filed criminal charges against persons unknown on suspicion of violating official secrets.

On Friday, February 28, the Frankfurter Allgemeine Zeitung (FAZ) published an article entitled "Wiesbaden's IT infrastructure - serious security gaps discovered", which contained confidential information from an internal report on network security at WIVERTIS GmbH, which was not accessible to the public. The reproduced content was only accessible to a limited group of people, so there is a suspicion that unauthorized disclosure to the FAZ was made by one or more persons within the administration, municipal bodies or other third parties.

On behalf of the state capital of Wiesbaden, Maral Koohestanian, Chairwoman of the Supervisory Board of WIVERTIS GmbH, has now filed criminal charges against persons unknown on suspicion of violating official secrets (Section 353b of the German Criminal Code) and all other possible criminal offenses. According to Section 353b of the German Criminal Code, anyone who discloses an official secret to a third party without authorization is liable to prosecution if this could significantly harm the interests of the state or a public body. "We will examine internally how the disclosure of confidential information came about and take the necessary measures," said Koohestanian.
